競馬での利益には税金が発生する！？
結論から言いますと、競馬で得た利益は、「一定額を超えると税金がかかります」。
税金がかかる一定額は「年間で50万円」です
そのため、競馬での利益が50万円を超える場合には確定申告が必要になります。
そんな競馬の利益の区別は下記の2つです。
・雑所得
・一時所得
それでは細かく説明していきます。
雑所得
過去に競馬で得た利益が雑所得に認められたケースがあります。
雑所得に認められた場合は、ハズれ馬券を経費に計上することができます。
雑所得として認められるには、「事業の実態がある」「事業として競馬を行う行為が必要である」などを明確にしなければなりませんので、競馬による利益が雑所得として認められることは極稀だと思っておきましょう。
一時所得
競馬で得た利益のほとんどが一時所得に分類されます。
主な理由としては、ほとんどの人が「営利目的で継続的に行っている」というわけではなく、あくまでも趣味として楽しんでいるということが挙げられます。
競馬の利益はバレない！？
競馬で得た利益はバレる？バレない？
年間を通して、競馬でまとまった利益を得ている人なら一度は気にしたことがあるのではないでしょうか？
競馬で得た利益が年間50万円を超えるにも関わらず確定申告をしなかったことによって税務署にバレる経緯は下記の3つです。
・銀行口座
・SNSなどのメディア
・ネットで馬券を購入
上記は税務署にバレる経緯に多い原因や例となっています。
それぞれを詳しく説明していきましょう。
銀行口座
銀行口座に高額な入金が定期的に行われていることで、その履歴から競馬による収益が入金されているとバレる場合があります。
高額といっても多少のムラがありますが、よく言われているのが「1回の入金額が200万円を超えること」です。
SNSなどのメディア
高額配当の馬券が的中した時に、その喜びのあまりTwitterなどのSNSに当たったことを書き込んだりするとバレる可能性が一気に高くなると思っておきましょう。
また、それらの書き込みを見た新聞社や各種メディアを通して公になる可能性もあります。
ネットで馬券を購入
ネットから馬券を購入した場合、確定申告をしないとバレる可能性が高いです。
いくつか理由がありますが、主にクレジットカードなどの個人情報と馬券購入履歴が紐づけることができます。
そして、高額当選をして利益が50万を超え、さらに口座に多額なお金のやり取りがされているにも関わらず確定申告をしていない場合は税務署の調査対象になり兼ねません。
購入するネットサービスによってもバレやすいバレにくいがあるかもしれませんが、バレたくないのであれば競馬場に直接足を運んで馬券を購入するのが良いかもしれません。
競馬の税金の計算方法とは
競馬の利益で税金を払う場合は、以下の計算方法で税金を算出することができます。
(収入額-支出額-特別控除50万円)÷2＝課税対象額
この場合、「収入額＝年間の総獲得金額」「支出額＝馬券代」になります。
納めなければならない税金は課税対象額に応じて税率が変わります。
節税のためにできることは？
今日から節税のためにできることは下記の2点です。
・ハズレ馬券を残しておく
・的中した時にメモを取る
競馬によって得た利益から、少しでも税金で支払う額を抑えたい場合は、所得区分を「雑所得」にすることが一番でしょう。
雑所得扱いになれば、馬券購入で支出したお金を経費として控除することができます。
もちろん、競馬による費用を雑所得にするためには、競馬を通じて得る利益が100％を超えるような事業としてみなされる運用・購入をしている場合のみであり、確実に雑所得に区分されるわけでもないので難しくはあります。
過去の事例から鑑みると、AI予想や予想サイトを利用したり、一定のパターンに従って馬券を自動購入するなどで利益を得ていた際に、裁判を通じて雑所得として認められたケースがあります。
それでは細かく説明していきましょう。
ハズレ馬券を残しておく
競馬の利益が雑所得であることが前提となりますが、ハズレ馬券は経費として控除対象になるので、予想がハズレた馬券は必ず残しておくようにしましょう。
馬券には購入額が記載されていますので重要な証拠になります。
的中した時にもメモを取る
日本国税庁のホームページからの抜粋になりますが、以下のような情報をメモに残しておくことが推奨されています。
l 開催日
l 開催場
l レース番号
l 払戻金に係る受取額
l 払戻金に係る投票額
これらの情報は、利益が出て確定申告をする際などに必要で、とても大事な情報になります。
税金を払わなかったらどうなる？
では次に、本来支払わなければならない税金を支払わなかった場合、それが申告漏れだったのか、はたまた悪意ある意図的な未納だったのかによってペナルティの内容が異なります。
一般的な税金を払わなかった時に起こるペナルティは下記の3点です。
・通常よりも多くの税金を払うことになる
・財産の差し押さえ
・場合によっては刑事裁判にも
それぞれを詳しく説明していきます。
通常より多く税金を払うことになる
納めるべき期限内に税金を払わなかった場合、「延滞金」が発生します。
所得税・相続税・贈与税など、国税として扱われている税金の支払いに延滞が生じた場合は、納期限から2ヵ月を経過すると延滞金の利率も高くなるので注意してください。
他にも、固定資産税・住民税・自動車税・個人事業主税のような地方税は、納期限から1ヶ月を経過する延滞金の利率が高くなります。
また、確定申告未申告が発覚して指摘された場合は「追徴課税」が発生する場合も。
申告漏れとして扱われた場合は、「無申告加算税」というものを支払わなければならなくなり、支払う税金に対し15％、50万円を超えた分は20％相当の額を上乗せして支払うことになります。
もしもこれが、悪意のある、いわゆる脱税として扱われてしまった場合は、無申告加算税とは別に、「重加算税」の支払いも必要になり、支払う税金に対して40％を上乗せして支払わなければなりません。
延滞金+無申告加算税、さらには重加算税など、税金の長期未払いに良いことは1つもありませんのでくれぐれもご注意ください。
財産の差し押さえ
税金の支払いが滞っていると財産の差し押さえをされてしまう可能性があります。
納期限を過ぎた国税未納の場合、原則として納期限から50日以内、地方税なら20日以内に納税者へ督促状が送付され、この督促状を受け取ってもなお税金の未払いが続く場合には財産差し押さえを通達する催告書が届く場合があるので注意してください。
他にも、市町村によっては、電話や直接訪問による催促・勧告が行われるケースもあります。
場合によっては刑事裁判にも
刑事裁判とは、刑法などの刑罰法令に背くような犯罪行為を行った者・疑いがある者に対して、有罪か無罪かを判決するためにおこなわれる裁判です。
もちろん有罪と判決されれば刑法にのっとり刑罰が適用されます。
競馬が原因で刑事裁判に発展してしまうケースとなると、やはり脱税です。
特に、悪意・故意に行った脱税かつ、その事象を隠滅するような行為を行った場合には徹底的な調査がおこなわれ、最悪の場合刑事裁判へ発展してしまうこともあります。
仮に刑事裁判まで発展しなくとも、前述の通り財産差し押さえや、職場や家族にも通知されることにもなるので注意してください。
まとめ
競馬による利益を得た場合は税金の支払い義務が発生することがあります。
支払い義務発生の所得額は50万円を超える場合です。
なので、税金の支払い義務の有無については、基本的にはどのような形であれ税務署にはバレていると思っておくと良いでしょう。
下手に隠すような行為や確定申告の未申告・税金の未払いをしていると支払うべき税金以外にも払わないといけない無駄なお金が必要になります。
また、税金の未払いによって思いもよらない大事件に発展してしまう可能性もあります。
そうしたリスクを避けるためにも、年間を通し、競馬で50万円以上の利益を得ている場合には必ず確定申告・税金の支払いを忘れずに行うようにしましょう。
また、競馬利益が雑所得として認められると、ハズレ馬券を経費にすることができます。
しかし、ほとんどの場合、競馬での利益は一時所得として扱われます。
雑所得に区分されるためには様々な条件をクリアする必要があり、それらをクリアするハードルは非常に高いです。
自分の収入・支出がどの所得に区分されるのかを確認することが大事だと言えるでしょう。
